BCCI's faux pas confuses Justice Lodha Committee

The Justice Lodha Committee has noted that the BCCI has not followed through in its assurance that an Extraordinary General Meeting would be held 'not later than 28th September' to finalise the implementation of the committee's recommendations.

BCCI's anomaly has been noted by the Lodha Committee in its status report to the Supreme Court.

The BCCI’s media advisory after its Annual General Meeting here on September 21 has even confused the Supreme Court appointed Justice Lodha Committee. Item 8 of the advisory sent to the media says:

"The emergent Special General Meeting of the BCCI will be held on 30th September 2016 at 11 AM IST at the BCCI headquarters, Mumbai to consider the amendments to the rules and regulations of BCCI as recommended by Hon’ble Justice Lodha Committee."

This anomaly has been noted by the Lodha Committee in its status report to the Supreme Court. An operative paragraph under item (5) says:

"It was stated in the BCCI report dated 25.5.2016 that an EGM would be called 'not later than 28th September' for the 'formal adoption' of the new memorandum. The BCCI did not honour this assurance, and on the other hand, at the AGM of September 21 took decisions contrary to the said assurance by deciding that the EGM would on 30th September 'to consider' the amendments to the Rules and Regulations."

But the BCCI in its notice addressed to the Honorary Secretary, All Affiliated Units of the BCCI, says: "To consider directions of Justice (Retd) Lodha Committee in connection with the formal adoption of the new Memorandum of Association and Rules for the BCCI."

The formal adoption of the new Memorandum of Association and Rules for the BCCI doesn’t require a two-thirds majority. The Lodha committee has re-written the MOU and Rules and Regulations for the BCCI to adopt in its 'Reforms in Cricket’ report.
