Niranjan Shah: 'There's ray of sunshine now'

The order on the Supreme Court website said "the draft Constitution approved by this Court shall not be debated upon and shall stand finalised."

Niranjan Shah feels the age cap of 70 for holding a position in the BCCI and state associations should be removed.

The Supreme Court order on the proceedings of the Justice Lodha Reforms on Tuesday, May 1 was welcomed by BCCI’s full members. "There is a ray of sunshine now. The SCA gave its suggestions many months ago,’’ said Niranjan Shah, former BCCI Secretary and a long-term Secretary of the Saurashtra Cricket Association. Shah strongly believes that age cap of 70 for a position in the BCCI’s Apex Council and more so in the State Association must be removed.

The order posted on the Supreme Court website said: "Suggestions to the same by various State cricket associations have also been filed and the same have been attached to the draft Constitution. The draft Constitution shall be finalised by this Court. In the meantime, if any State cricket association intends to file any further suggestion, they may submit the same in bullet points to Mr. Gopal Subramanium, learned Amicus Curiae, who shall compile the suggestions and file it before this Court within three days.’’

Most importantly the order further said: "It is hereby made clear that the draft Constitution approved by this Court shall not be debated upon and shall stand finalised, only subject to the determination made in the application(s) for recall of the primary judgment, pending adjudication before this court.’’

More than half a dozen associations have referred the protection given under 19(1) (c) of the Constitution of India and have prayed for recall of the judgment validating the Justice Lodha Reforms on July 18, 2016.
